Is Silver Surfer's working as intended

Has anyone else noticed an issue with ss heavy phase at the start of the fight? Though it isn't every time. When activating his heavy as soon as the fight starts I've repeatedly been hit even though it should activate a phase w/ 100% chance to miss.
Aside from that there have been cases when I've activated 2 different buffs from my spc1 (power gain/fury or fury/armor etc.) I was under the impression that depending on the rotation you get 2 of the "same" buff depending on the power cosmic rotation.
Note: the spc1 does this when you activate it as soon as the power cosmic buff rotates.

    Same. The one with the heavy phase happens to me too but it didn't at the start. I was fighting RoL WS and I wanted to phase his Sp 1 bullets but I got knocked down. The second one happened to me in AQ.
