Can you get banned for scamming?

Probably no.
Why someone should be banned for getting a gift from another that gifted it at his very own will?
Also banning for receiving gifts could also easily be exploited.
You could just gift something to someone you would like to be banned and then claim he scammed you.
Imagine what a storm of issues this could cause to support team.
All players must be aware of the risk of not getting gifted back when exchanging gifts with random people.
They should not be naive and then expect Kabam protect them like they are kids.

Why you are gifting randoms?
Exchange gifts with your alliance mates, friends or even forum members.
It’s not the first year gifting event happens. You should be aware of the risk on gifting randoms and expect to be gifted back.
Sorry, but if you got scammed the fault is yours 🙁

This comes up every year. They won't do anything for you. Don't trade with people outside your alliance that you don't know.

Even that's still not safe. A guy in my alliance scammed two other members for several thousands of units worth of GGCs. He then left the alliance and has totally got away with it.

Ouuuch! That hurts. Maybe I just have too much faith in my alliance. I gifted GGCs and received double what I sent.

You can't be banned for receiving a gift, or even for not returning a gift. However, if Kabam chooses to investigate, and sees direct evidence of scamming, and decides the conduct is actionable, then yes they can in fact ban people for doing this. There's no guarantee it will happen, but it could happen at Kabam's discretion if the conduct is egregious enough. For example, if multiple people all report the same person for multiple infractions of the same bad behavior, or if the amounts are high enough, or if the conduct recorded is sufficiently abhorrent.

But if someone says "anyone wanna trade" in global and you send them something and they don't send back, I wouldn't hold my breath.

The purpose of the gifting event is to have players interact with each other through gifts. Buying them for yourself doesn't fit the purpose of the event. Of course, buying gifts from a second account and sending to your primary account also doesn't fit purpose, but this is seen as not worth going after specifically, because it is too complex to police. They do, however, police things like people selling gifts outside the game in the grey market. Technically it is still gifting, but it subverts the purpose of the event enough, and causes enough problems with the game as a whole, that Kabam sanctions the practice when they can prove it occurred.

Actually, the word "exchange" "trade" already defeat the purpose of gifting event.
I buy gift for someone with the hidden agenda that I expect that someone would sent me back. Its barter, not gift.
Interact? Yes some inactive/nonresponsive players in AQ/AW would suddently write in game chat and ask for "trade". Is that the purpose of this event?
I still remember the vis from COWhales talking about the dynamics of last year's gifting event. Is that funny to talk about the purpose of gifting event now? The nature has already changed.
So, if you really want to gift something to others. Treat it as a "gift".
