Spot on Defence

So I use spot on offence, I've learnt his specials, i can dex his specials and I can punish with a heavy which is the idea stop him gaining Spots...

So why does he ALWAYS have 5 spots by the time he drops his special meaning i can't heavy punish because it will trigger his untouchable? Is this an oversight or am I doing something wrong?

Surely Kabam would have tested this out right? 👀
