When did Apoc start fight with 3 charges on Def

I just had 2 fights against Apoc in Incursion and both time he got 3 charges.

I remember before he only start with 2 charges.

When did this change and will it ever be impl in BG for Attacker?

Is he the boss? He always starts with 3 if he’s on the boss node.
