Champs evading and taking damage

Posted earlier about Spiderman AI "evading" during Punisher 2099 L1 and getting clipped with the last couple of shots. That was in dungeons.
Ultron just took three hits from AA's L2 in AQ for the same reason. The AI decided to "help" by having him "evade" back from the first hit but instead of keeping the guard up (finger hadn't left the screen) he takes the next three hit to the chin. How have you managed to screw this up?
