It's legal as long as it's you using them, as long as it's you who created the accounts. You can have as many accounts as you want on as many devices that you want to use.

I have two accounts and two phones, that I can switch into the accounts that I made if i need to.

I started with one account for my son who showed no interest and soon found out that I loved the game. I kept playing and encouraged my wife to play as well. I created an account for her with her email and personal password but she also showed no interest. I decide to keep both account and have since grown both account with hours and lots of money. In keeping both accounts am I in violation of the terms and conditions since I’ve been temporarily banned in the past?

In the technical sense, yes. Only you can operate your Account. As for their detection methods and actions, I can't comment on that. Technically, using any Account that is not your own is a violation.

Technically, all three accounts are his. Kabam's policy is the person who creates the account is the owner of the account.

So you're right. I overlooked the part where he said he started them. I suppose you could say it was Account Sharing either way, but I won't nitpick it. Lol.
