Human Torch incinerates are not working as intended

HT incinerates are falling off really fast in Cav EQ and limbo side quest. The whole science champ quest they were falling off really fast in the first half of every fight. Limbo side quest on legendary on the shock path Mr Fantastic was even getting incinerates until a 20 seconds or so into the fight. Some were falling off fast and then finally back to normal.

His incinerates fluctuate based on temperature from a low of only 3 seconds
