Is Act. 6.3.5 Mysterio able to poison even he has his helmet breaked?

Can he gain chemical gas charges even hi has an armor break debuff?

As you can see he has an armor break debuff and his helmet is breaked but he was able to place the poison debuff.

I breaked him after he reached 3 charges.

He doesn't lose charges when he already has them, he just cannot gain more.
