Prof X's falter not working

So I was trying to complete 3.1 EQ and I've used like 20 revives because everytime I try build up charges nick fury just kills me even though it should have a faltered hit. Sometimes it won't work for 1 hit or just not work at all. Is someone else experiencing this?
