When on even it triggers 1 out of ever 1 times. If it is not doing so then that is not a silent nerf, its a bug.
My money is on the fact you didn't really fully understand how he works but should that be wrong, then record proof of the bug and provide kabam with a bug report and it should be patched in 2 to 3 years.
