You signed a EULA that said you waive your legal rights to a certain degree. They have made a statement about the danger to photosensitive users. Stay safe and all, but this isn’t a brand new discovery.

The issue has been identified and Kabam have issued a warning. Hopefully they will do more about it soon.

Just FYI, epilepsy is affected in many, many, many ways. What happened to your friend, could have happened to them at any time from any number of sources.
