BWCV Death Immunity

Hi all, need someone to help my understanding as I'm not sure if it's a bug or just something I may have missed... Im using BWCV against silver surfer mini boss in AQ and both times recently, hes failed to drop a special so I've used my sp3 to take him to his sp3 which he uses straight away but instead of me being immune to death and regenerating up to 20% health I just die... so death immunity isnt working. I cant see any mechanic from Surfer that would stop this working and it's not easy to recreate this particular situation in AQ but yes she is awakened and at sig 120.
Any ideas why this isnt triggering?

    Yes had 6 charges both times and the special was dropped immediately after mine finished so not even half a second between them.

    I had similar issue in aw. All or nothing path, I had claire vs Claire. I used S3 first and then opponent used theirs. Then I died with death immunity active.
