Why is fury losing his tactical charges while in his second phase?

I was exploring act 5.2 earlier and I was using nick fury who was losing his charges and not doubling them in the second phase. It was in the buffet quest so I was wondering if that caused the charges to run out but that doesn’t explain why they aren’t doubling. I took a video to show what I’m talking about.

    Buffet ate your fury buff. Need that to double and hold charges

    Because he doesn't have an active Fury effect as per his ability description.

    Tactical charges don’t decay if you have a fury up. Buffet took away your fury buff so your charges started falling off.

    Okay. That explains the charges running out but why does he not double them? I was pretty sure even without the fury buff he still doubles his normal charges.

    As per his ability description.
    Double tactical charges also requires a fury’s fury buff.
