    This was intended that way. Hyperion is part of an "alternative" version of the Justice League that Marvel has. Squadron Supreme.

    The story is that there was a comic book writer who wanted to do work for DC because he loved Superman/The Justice League but he never got the chance so he found work for Marvel and created copies of The Justice League known as “The Squadron Supreme”. The DC clones were:

    Nighthawk - Batman
    Hyperion - Superman
    Power Princess - Wonderwoman
    Dr. Spectrum - Green Lantern
    Whizzer/Speed Demon - The Flash
    Skrullian Skymaster - Martian Manhunter
    Amphibian - Aquaman
