Evade in Swashbuckling mode

In alliance war, just fought a Nightcrawler and I was able to switch him to swashbuckling mode early in the fight. However, he still managed to evade once and counter attack.
I seem to have read about this before, but wasn't sure whether this was a confirmed bug or not. Also unfortunately I wasn't able to record the fight, so I don't have any visual proof.
