Ultron Variant 2.3 - Passive Evade on Boss???

What is a passive evade?

Spry (the node on the boss) - Each time the defender passively evades an attack, a Fatigue Debuff is placed on the attacker, reducing their critical rating by 1,000 for 5 seconds

I took in my Ghost (phased, 1 hit, phased, 1 hit, phased, 1 hit....) and I still had a fatigue debuff placed on me. Ghost's critical hits can't be evaded so I assumed I wouldn't have to worry about this, but I was wrong. Shouldn't her ability negate any evade ability, including passive evades?

EDIT: I beat the boss...I just want to know for the future, in case this node comes up again.

    The drone itself has a chance to give you a fatigue debuff when you attack him. You avoided one way, not the other
