Bug - Variant 3.3.1, Spry path. L3 special with no fatigue prior = dead

Version: Latest on both MCoC and Android
Node: Spry path in Variant 3.3.1
Defender: Daredevil, Spiderman, Ultron classic
Attacker: Emma Frost, R4/55 5*, Domino, R5
Issue:
This has happened once on each of the above defenders with either of the above attackers. No fatigue debuffs on my character prior to firing off their L3 - after the animation is complete - I see a fatigue trigger and my character dies afterwards. It is treating it like the Spry/Fatigue buff happens during or at the end of the L3, and reflecting all of the trigger damage back at once. If there is NO fatigue prior to firing the L3, I should not be taking damage from the L3 after it is done.
