Using prof x against prof x.

There are two things I'm confused about here.
First, is that the falter still activates and I miss despite having the necessary amount of charges to bypass said mechanic. I tested prof x against maw, and I had no problems there. Its just against prof x.
The second happened when I went to use a sp3 with 100 charges. Mind control activated, but I did not have enough power to use a sp2 immediately after like I usually do. I could still use the sp1, so it appeared that I maybe suffered the tech disadvantage? I tested this multiple times all to the same outcome.
