Crossbones pause fury at no fury cost NOT WORKING

When you heave with Crossbones he pauses his furies for the cost of one fury. It is not supposed to cost a fury if you heavy someone recovering from a special. I have been running the ROL trying to get used to the new awesome updates to Crossbones and it still costs a fury even when you heavy Winter Soldier when he is recovering from his SP1. Has anyone else had this issue? Is this a problem that is known yet?
