About Hercs immortality

in Bugs and Known Issues
In aw herc didn't activate his immortality. The fights were on 35 and 53 nodes against spidy stealth and iron man iw. They just made k.o. by hitting me in block. Did anyone face the same problem? Or maybe i didn't understand right his abilities?
