Emma frost is immune to cruelty passives in diamond form?

This seems like a bug to me, and is not discussed anywhere in her abilities, but it is a repeatable bug that you can see in this month's EQ. Reproduction instructions:
* take Emma Frost on any "arrow to the knee" node (e.g. the path starting with Blade in EQ chapter 2.2)
* With this node, interrupting the defender's heavy should transfer 1 cruelty passive to the attacker
* If Emma is in diamond form when she interrupts the heavy, 1 cruelty passive is subtracted properly from the defender, but Emma does not receive one.
* If Emma is in telepath form when she interrupts the heavy, she received a cruelty passive as expected. Then, the next time Emma switches to diamond form, it is removed.
In other words, Emma acts in all respects as if she is immune to cruelty passives in diamond form. This is not listed as a feature of the diamond form (and indeed, the cruelty passive is a positive effect, and diamond form does not list immunity to any positive effects).
