If this was just implemented as an in-game message which we have to claim / but could wait a few days to do so while clearing our our inventory (similar to AQ and glory... which I am also having to have sit in my inbox because of the awesome crystals this month seeming to have a 75% glory drop rate for me... and I can't spend it fast enough).
What was lost: last season, if we knew we had "use or lose marks", we might have tried to get better solo rewards / more points in the alliance/solo events... but the implementation wasn't entirely clear.
Personally, I'm in the same boat on my alt. I'm sitting on 8910 Elder Marks. I barely lose, and do my part every season to hit the 300k minimum. usually end up at 400k-450k points and close to max cap every season. I manage the EM acquisition throughout the season so as never to go above the cap (9k). When it was announced we will get the prior rewards with seeding, i'd assumed it will go the same way EVERY reward in the game is delivered, through the mail. Now i'm stuck, and will potentially waste nearly 1.5k Elder Marks with this auto claim. There is no fault of my own in this. It is on me to manage my resources, and I do that well. There should be no punishment for maintaining a healthy stash of elder marks. Each account is different, people play differently, and hoarding isnt wrong. In the end, i hope Kabam compensates for the missing EMs, because that is the right thing to do. There was no communication as to how these rewards would be distributed, so the players cannot be blamed for not prepping for this scenario.

He is still trying to explain to the lawyer wth elder marks are, it's not easy to process all the currency in pixels and convert them into dollars to actually have a settlement ammount. From what I hear so far the lawyer so far has calculated the settlement will be worth a hot dog and a small coke, no mustard, ketchup or any toppings at all. He is evaluating wether his 30% fee is worthy.

1) well if we are debating semantics, except a very few exceptions, everything is "manual claiming". Is that good enough for you?
2) Well, if this thread wasnt good enough for you, autoclaiming a massive stack of rewards with caps offers no control in resource management. There are people who hold onto resources, in this case elder marks, for various reasons. When a better solution that works for EVERYONE is available, it would seem using a less effective answer is counter intuitive, no?

Did a little bit of mental math for fun. (To be fair, I don't like how this happened and got screwed out of EM as well.)
Assuming you were capped at 9k elders marks at the start of the season and were to start in plat 1 (i.e., would receive 2,200 elders marks). You could run 5 matches with elders marks before the autoclaim - so now you are out 2,200 - 450 = 1,750 elders marks.
In the BG store, elders marks are 135 units for 315 elders marks. 1,750/315 * 135 = 750 units of value (less than $30 in the Unit Store).
My hourly rate as an associate (not partner) in private practice was around $300. We billed in 6 minute increments. In other words, the 5 minute phone call (where you would get laughed out of the room) to discuss this lawsuit would cost more than the cost of the elders marks you would need to purchase to make up the difference. Then again, maybe someone would take the case pro bono

The moment their client asserted the marks were worth even $30 in a legal filing, Kabam would have cause to terminate their account for violating the TOS, which requires him or her to agree that in-game materials and resources have no material value. So they could simply send him a compensation package with the materials, then immediately perma-ban the account. This would be a pyrrhic victory at best.
Again, the situation sucked and I hope Kabam fixes it (at least moving forward).
It does, and it parallels some other overflow issues recently that I think would be best handled by having overflow warnings when rewards are about to be claimed or otherwise transferred, so players can take mitigative or corrective action.
